Terms of Service

These Terms govern your use of Ponti (“Ponti”, “we”, “us”), a platform that connects brands with content creators, holds campaign funds in escrow, verifies delivered work, and pays creators. By creating an account or using Ponti, you agree to these Terms. If you do not agree, please do not use Ponti.
1. What Ponti does
Ponti lets a brand fund a campaign, matches it with vetted creators, uses an AI agent (with human review for low-confidence cases) to check that submitted content meets the brief, and releases payment to creators once work is approved. Ponti is the platform and payment coordinator; brands and creators contract with each other for the work itself.
2. Accounts
You sign in with Google. You must provide accurate information and are responsible for activity under your account. You must be at least 18 years old and able to enter a binding contract. One person or business, one account, used honestly.
3. Brands
- You fund a campaign upfront; those funds are held in escrow (see §6).
- You provide a clear, lawful brief and accurate targeting.
- You may dispute an approved submission within the stated dispute window; otherwise funds are released to the creator.
4. Creators
- You create original content that matches the brief and does not infringe anyone's rights.
- You must not use bots, bought followers, fake engagement, or misrepresent your reach. Ponti measures trust through real, verified delivery — not follower counts.
- You are responsible for disclosing paid partnerships as required by law and platform rules.
- You provide accurate payout details (e.g. M-Pesa number).
5. AI verification
An AI agent assesses each submission against the brief and returns a decision with a confidence score and reasoning. Decisions below a confidence threshold are routed to a human — the AI is never the final authority over payment. Verification is a good-faith assessment, not a guarantee of a submission's performance or legality.
6. Payments, escrow and fees
Campaign funds are held via a licensed third-party payment provider, not in Ponti's own accounts. Funds are released to the creator after approval and the close of any dispute window. Ponti charges a service fee (currently 15% of the creator pool), shown before you fund. Payouts are made to the creator's M-Pesa or bank on the stated payout cycle. Payment provider terms and fees also apply.
7. Prohibited conduct
- Fraud, fake engagement, bots, or manipulating the Trust Score.
- Infringing intellectual property or posting unlawful content.
- Circumventing Ponti to avoid fees, or abusing the dispute process.
- Attempting to disrupt, reverse-engineer, or gain unauthorised access to the platform.
8. Suspension and appeals
We may suspend or remove an account for breaching these Terms or for conduct that harms other users (for example, off-platform fraud or misconduct). A suspended creator may submit an appeal, which we review before deciding.
9. Disputes and liability
We facilitate resolution but are not a party to the underlying work agreement between brand and creator. To the extent permitted by law, Ponti is provided “as is” and our liability is limited to the fees you paid us for the campaign in question. Nothing here excludes liability that cannot be excluded by law.
10. Changes
We may update these Terms. Material changes will be notified in-app or by email, and continued use after a change means you accept it.
11. Governing law
These Terms are governed by the laws of Kenya, and disputes are subject to the jurisdiction of the Kenyan courts.
